How to Sponsor an Employee

To sponsor an employee for a Temporary Skill Shortage 482 visa or a subclass 494 Skilled Employer Sponsored Regional visa, you need to be a standard business sponsor.

Steps to becoming an approved Standard Business Sponsor:

  1. Gather your supporting documents
  2. Lodge your Standard Business Sponsor form and pay the sponsorship application fee.
  3. Receive your approval and a Transaction Reference Number (TRN)

Step one. Gather your supporting documents.

Documents for a business trading in Australia

In your application to become a standard business sponsor, you’ll need to provide documents that support the following criteria:

Lawfully operating business

To show you business is lawfully operating, you can useyour ABN, company and trading name if you operate as a company, or if it operates as a franchisee, Trust deeds or a joint venture agreement, or relevant information such as signature pages of contracts or deed (a business that exists on paper only is not applicable);

details of the principals of your business, such as its Owners, Partners, Directors and major Shareholders;

financial statements and bank statements covering the past 12 months, tax returns and BAS statements

and have no relevant adverse information against your business.

Commitment to employing local labour

You’ll need to confirm in writing your strong record or commitment to employing local Australian labour.

Non-discriminatory recruitment practices

You will need to declare that your business does not and will not engage in any discriminatory recruitment practices.

Documents if your business does not operate in Australia

Intention to set up in Australia or Contractual Obligation in Australia

If your business is not currently operating in Australia, you will need to show your intention to set up a business entity in Australia or that you have a contractual obligation in Australia. You can do this by providing:

A company or business expansion plan;

An agreement to enter into a joint venture;

A contract between you and an Australian party;

If your business is not registered in Australia, you must show that it is. You can do this by provide evidence of registration in the country you operate in.

Skilled labour need

If your business does not operate in Australia, you must be able to show that you need a skilled worker to come to Australia to establish, or help to establish, a business operation with connections with a business located outside of Australia or to fulfill, or help fulfill, a contractual obligation.

Documents if your business is new

If your business is brand new, you can still become a standard business sponsor. You’ll need to provide documents that support the following:

You can do this by providing:

a detailed business plan, ideally with contracts to provide services;

business bank statements;

a lease agreement;

evidence of employing staff;

BAS statements from the start of operations.

Step two. Lodge your Standard Business Sponsor form and pay the sponsorship application fee.

Once the relevant documents are prepared, your Standard Business Sponsor application can be lodged. Step three. Receive your approval and a Transaction Reference Number (TRN)

When you receive your approval, your business is now all set to sponsor a skilled worker from overseas for a Temporary Skill Shortage Visa (482) visa or a 494 visa.

The TRN number will be needed by the sponsored employee you wish to nominate for a TSS 482 visa or a 494 visa.

At this point, your business also undertakes obligations with its new status as a standard business sponsor.

How long is the standard business sponsor status valid for?

Your standard business sponsor status is valid for 5 years on approval.

The government’s fee for the sponsorship application is AUD 420.
